Terms of Service

You must be at least 13 years old to use biu. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into this agreement.

You need an account to use most of biu. You’re responsible for keeping your login credentials confidential and for all activity that happens under your account. Let us know immediately at admin@getbiu.app if you suspect unauthorized access.

You can delete your account at any time from within the app’s settings, which will permanently remove your account and associated data as described in our Privacy Policy.

biu lets you upload or link videos, PDFs, photos, and notes, and uses artificial intelligence to generate summaries, flashcards, and daily quizzes built on spaced repetition, along with an AI tutor grounded in your own material. We may add, change, or remove features at any time, and may suspend or discontinue all or part of the Service, though we’ll try to give you reasonable notice of any change that materially reduces its functionality.

New accounts start with a 14-day free trial of biu Pro, no payment method required upfront. You can extend your trial through the referral program described below.

After your trial ends, continued access to Pro features requires a paid subscription. Subscriptions are billed and managed entirely through the Apple App Store or Google Play, depending on where you downloaded biu, and are subject to that platform’s own terms of service and payment terms.

• Price and billing frequency are shown in the app before you subscribe, and may vary by region and promotion.
• Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.
• You can view, manage, or cancel your subscription at any time in your Apple ID account settings (for App Store purchases) or your Google Play account settings (for Google Play purchases).
• Cancelling stops future renewals but does not refund the current billing period; any remaining paid access continues until the end of that period.
• Refunds are handled by Apple or Google under their own refund policies. We don't have the ability to issue refunds directly for App Store or Play Store purchases.
• We may change subscription pricing going forward. If a price change affects your existing subscription, we (or Apple/Google, depending on the platform) will notify you before it takes effect.

biu lets you earn extra trial days by referring friends using your personal referral link. When a friend signs up through your link, your trial immediately extends by 7 days. For each day your referred friend completes their daily quiz during their first 14 days, your trial extends by an additional day, up to 7 more days, for a total of up to 14 bonus days per successful referral.

We may change referral bonus amounts, add limits, or end the program at any time. We may also withhold or reverse bonus days earned through fraudulent, abusive, or automated referral activity, including fake accounts or self-referrals.

You retain ownership of everything you upload to biu — your videos, links, PDFs, photos, and notes, along with the summaries, flashcards, and quizzes generated from them (“Your Content”).

By uploading Your Content, you grant biu a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display it solely to operate and improve the Service for you, including sending it to the third-party AI providers described in our Privacy Policy. This license ends when you delete the content or your account, except for copies retained briefly in backups as described in our Privacy Policy.

You’re responsible for Your Content and confirm that you have all rights needed to upload it and to have it processed by biu, and that it doesn’t infringe anyone else’s rights or violate any law.

Summaries, flashcards, quiz questions, and AI tutor answers are generated automatically by third-party AI models based on Your Content. They may contain errors, omissions, or inaccuracies, and should not be treated as a substitute for your own judgment, your source material, or professional or academic advice. You’re responsible for verifying anything important, especially material you intend to rely on for exams, coursework, or professional purposes.

You agree not to:

• Upload content you don't have the legal right to use, or that infringes someone else's intellectual property or privacy.
• Upload unlawful, defamatory, hateful, sexually explicit, or otherwise harmful content.
• Use automated means (bots, scrapers) to access the Service or create accounts, including to manipulate the referral program.
• Attempt to reverse-engineer, decompile, or interfere with the Service or its underlying AI models.
• Resell, sublicense, or provide access to the Service to third parties without our written permission.
• Use the Service in any way that violates applicable law or the terms of the Apple App Store or Google Play.

We may suspend or terminate accounts that violate this section.

The biu name, logo, app, website, and underlying software and design are owned by FlipFlop Labs Private Limited and protected by intellectual property laws. These Terms don’t grant you any rights to our trademarks, branding, or source code beyond what’s needed to use the Service as intended.

biu relies on third-party services to operate, including Supabase for backend infrastructure, OpenAI, Anthropic, and Google for AI processing, and Apple and Google for distribution, sign-in, and billing. Your use of those platforms is also governed by their own terms, and we aren’t responsible for their availability, content, or conduct.

If you downloaded biu from the Apple App Store, the following additional terms apply, and take precedence over any conflicting term in these Terms as between you and Apple:

• This agreement is between you and biu only, not Apple, and Apple is not responsible for the Service or its content.
• Apple has no obligation to furnish any maintenance or support services for the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service or your possession or use of it infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

You may stop using biu and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably possible. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content, to the fullest extent permitted by law. We don’t guarantee that biu will be uninterrupted, error-free, or that it will help you achieve any particular learning outcome or exam result.

To the maximum extent permitted by law, FlipFlop Labs Private Limited and its officers, employees, and service providers won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim arose, or 5,000 Indian Rupees, whichever is greater. Some jurisdictions don’t allow these limitations, so some of them may not apply to you.

You agree to indemnify and hold harmless FlipFlop Labs Private Limited from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Subject to any rights you may have under mandatory consumer protection laws in your country of residence, you agree that any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.

We may update these Terms from time to time. If we make material changes, we’ll notify you through the app, by email, or by posting a notice on getbiu.app before the change takes effect. Continuing to use biu after a change takes effect means you accept the updated Terms.

If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a right or provision isn’t a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, are the entire agreement between you and biu regarding the Service.
